Rochester Police: Man arrested, facing murder charges in deadly double shooting

ROCHESTER, N.Y. (WHEC) — Rochester Police say they’ve arrested a man connected to a deadly double shooting at a downtown apartment building in November.

RPD Wednesday said 29-year-old Timothy Brown was taken into custody by Greece Police early Tuesday morning. They say he shot and killed 22-year old Tywan Harper 19-year old Malakai Smith inside the apartment building on Chestnut Street on the morning of Nov.11.

The murders marked the 69th and 70th homicide victims in Rochester in 2021.

Police say they recovered a gun at Brown’s home at the time he was arrested. He’s charged with two counts of second-degree murder and two counts of second-degree criminal possession of a weapon.

He was due to be arraigned in Rochester City Court Wednesday morning. RPD said additional charges may be presented to
Monroe County Grand Jury by the Greece Police Department for the gun recovered in his house.

ADDITIONAL SEARCHES, ARRESTS.

After Brown’s arrest, multiple search warrants were executed in the City of Rochester and Town of Greece. RPD says one of the searches brought in a loaded gun, and the arrest of 33-year old Carl Stein.

Police say Stein is facing two criminal possession of a weapon charges. He was arraigned in court Wednesday morning. Police did not say if the searches were tied directly to Brown’s arrest.

RPD says SWAT teams assisted in the searches. Many callers in the area reached out to News10NBC Tuesday night about hearing loud booms in the area. Police confirmed those booms came from the SWAT team’s entry into a home.

Cmdr. Greg Bello sent the following statement Wednesday:

"The Rochester Police Department has received multiple inquiries into a “loud boom noise” heard in the Charlotte area last night. As part of the investigation into the double murder at 35 Chestnut St, multiple search warrants were executed last night in the City of Rochester and Town of Greece. In particular, at approximately 9pm, the Rochester Police Department SWAT team executed a search warrant in the 3900 block of Lake Avenue. During the execution of this search warrant, the SWAT team utilized at least 1 Noise Flash Diversion Device. This very easily could have produced the “boom” or “booms” heard by area residents. Due to the sensitive nature of SWAT tactics and procedures, we will not be releasing any more information related to the execution of this search warrant."
