RPD: 2 businesses temporarily shut down as part of emergency order to curb violence

ROCHESTER, N.Y. (WHEC) — Rochester Police now say two locations have been temporarily shut down as part a new emergency order that allows RPD to close businesses where a shooting has occurred in the past 30 days that have also too many nuisance points.

The requirements are 12 nuisance points in the past six months or 18 nuisance points in the past year.

The two businesses are the Black Bear Pub, on West Ridge Road, and El Cuchifrito Restaurant and Lounge on Norton Street.

This comes after a deadly shooting behind the pub on over the weekend. It happened as the crowds were coming in and out of the pub.

A notice to shut down as of Thursday was posted on the doors to the pub Thursday night, saying no one should occupy the Black Bear until it’s cleared by the police. According to the city’s website, Black Bear has 26 nuisance points.

A representative for the business told News10NBC Reporter and Anchor Charles Molineaux he has been trying. He said the night of the shooting, the business called for police help.

The New York State Liquor Authority still listed the business’s license as active as of 5:30 p.m. Thursday.

The State of Emergency was enacted on Nov. 12 following a spike in violence that has resulted in the highest one-year homicide total on record: 75.

In updated guidance released Friday, RPD says a suspended business will have to meet with their local Neighborhood Service Center (NSC) to hash out an abatement plan. After the two sides agree on the plan, they can sign it, and the business would be allowed to reopen with approval from RPD.

On Wednesday, Nov. 24, Black Bear Pub petitioned the City of Rochester, Mayor Lovely Warren, the Rochester Police Chief and the RPD in a move to re-open.

The pub wants an injunction against the closure order.

News10NBC reached out to the City of Rochester but was told it does not comment on pending litigation.

The State of Emergency and any orders that result from it will remain in effect through at least Dec. 12, 2021, but it could be renewed for another 30 days.
