Woman charged in deadly Clay Road stabbing sentenced under Domestic Violence Survivors Justice Act

ROCHESTER, N.Y. (WHEC) — Prosecutors say the woman charged in Rochester’s first homicide of 2021 was a victim of domestic violence.

Patricia Hutton pleaded guilty to first degree manslaughter for stabbing 52-year-old Antonio Addison to death on inside the Clay Road home they shared back on Jan. 10, 2021.

Hutton worked with Willow Domestic Violence Center to apply for consideration for Domestic Violence Survivors Justice Act (DVSJA) sentencing.

The Monroe County District Attorney’s Office determined Hutton was a victim of domestic violence and that the abuse “was a significant contributing factor" to her behavior.

Under the DVSJA sentencing for the manslaughter conviction was reduced from five to 25 years in New York State Department of Corrections to one to five years. She was sentenced to three years in the Department of Corrections plus five years of post-release supervision.

The DVSJA was signed into law in May of 2019. It allows defendants who have a history of sexual, psychological or physical abuse that contributed to their conviction to be sentenced or resentenced with the abuse taken into consideration.
