Details on felony complaint filed against 14-year-old Gates Chili student charged with rape

GATES, N.Y. (WHEC) — A 14-year-old student from Gates Chili High School is charged with two Class B felonies – criminal sex act first degree, and rape first degree. Although he is a minor, he is being charged as an adult.

On Tuesday News10NBC’s Emily Putnam obtained a copy of the felony complaint against the defendant from Monroe County Court, which contains a graphic and disturbing description of a sexual assault. Gates Police say they were made aware of the incident on Sept.18, the day after it is alleged to have occurred at Gates Chili High School. A weeklong investigation with the school district took place after that.

The felony complaint states that on Sept. 17 around 3:15 p.m., the defendant “did forcibly pull the 15-year-old female victim into the boy’s bathroom at Gates Chili High School.”

Upon entering the bathroom, the complaint says that the defendant forced the victim to perform multiple sex acts and that she said “No.” The complaint goes on to say that upon completion of the acts, “the defendant left the bathroom prior to the victim.”

A forensic interview about the incident was completed at the Bivona Child Advocacy Center. News10NBC spoke with Bivona Executive Director Deb Rosen, who shared some alarming statistics about sexual assaults between children.

"At Bivona we see numerous sexual assaults of children,” said Rosen. “We see about 2,000 children every year in Monroe County who may have experienced sexual assault, and about 25% of those acts are actually committed by other children."

Bivona couldn’t speak in detail about the case because the organization is directly involved in the investigation. Gates Police Chief Jim VanBrederode confirmed that the teens were “classmates” at Gates Chili High School.

The 14-year-old defendant (who News10NBC is not naming because he is a minor) was arrested on Monday and is not allowed on school grounds. The 15-year-old female victim has an order of protection against him.
