Manslaughter charge in Batavia overdose death

BATAVIA, N.Y. (WHEC) – A Batavia man has been charged with manslaughter in connection with an overdose death late in 2021.

Batavia Police say they received a call on December 30 that two adults had overdosed in front of their children at Northside Meadows apartments. 38-year-old Anda Ithna-Asheri was found dead. 61-year-old Makeen Ithna-Asheri was found unresponsive. Narcan was administered and he recovered.

On Tuesday, BPD charged Makeen Ithna-Ahseri, the father of the chldren, with second-degree manslaughter and two counts of endangering the welfare of a child. He’s accused of providing the drugs which led to the overdose, and failing to provide proper aid. Police say Makeen also prevented the children from calling for help when he took their phone away. The children are now in the custody of a relative.

Batavia Police say when he was taken into custodyIthna-Asheri was in possession of crack cocaine and charged with criminal possession of a controlled substance, 7th degree.

BPD says Makeen Ithna-Asheri is on lifetime parole for murder. He’s in Genesee County Jail and is also being held on a parole warrant. He’s scheduled back in court on February 22.
