Police: Driver facing DWAI, other charges following crash that killed Penfield teen

ROCHESTER, N.Y. (WHEC)—Rochester Police say a driver is facing several charges after a Saturday crash in the city that killed a Penfield teen.

The driver, whose name was not released by police, was charged with third-degree aggravated unlicensed operation of a motor vehicle and driving while ability impaired with drugs (Marijuana).

The crash happened at the intersection of Chestnut and Elm Streets around midnight, as police said 16-year-old Matthew Bittner was hit by the car as he crossed the street. Bittner later died Sunday.

The district released a statement in response to Bittner’s death, saying it would be providing counselors to students and staff.

The driver was heading north when he told police due to the heavy rain, he did not see Bittner until the last second. Police say he swerved to try and avoid Bittner. He stayed at the scene.

Due to Bittner’s death, the RPD’s Major Crimes Unit is handling the investigation and is working with the Monroe County District Attorney’s Office to figure out if additional charges will be pressed.
