Pines of Perinton tenant files lawsuit

PERINTON, N.Y. A negligence lawsuit has been filed against Winn Companies, property owners of the Pines of Perinton. The tenant who filed it says she’s had a legal battle with the company before.
“This is not the first time that they’re being sued by my mom, because my dad had fell before outside when they failed to put salt down,” said Tiffany Porter, McCullough’s daughter.
Carrie McCullough has filed a lawsuit against Winn Companies before. This time it’s traveled up to Monroe County Supreme Court.
“This one has gone to the supreme court because its higher and there is a pattern of gross negligence on behalf of Winn management,” Porter said.
The suit details health code violations her parents say they’ve been living with for decades: slippery old carpets that have caused them to fall down the stairs, mice infestation and more.
“They’re living in literal hell, and no one is really paying attention and so we’re trying to bring light into the Fairport, Perinton community to help these neighbors out,” Porter added.
We met this family back in January, right after the devastating fire that displaced over 60 people. Porter says the fire brought attention to issues that she says tenants, including her parents, have been dealing with for a long time.
“I mean these issues have been going on for over a decade,” Porter said. “The fire just brought to light the mishandling of the property and how they have not been keeping up with codes, how they didn’t have fire hydrants that were working on the day of the fire.”
I reached out to Winn Companies on the lawsuit. At first they told me they didn’t know anything about it. I got a statement from its spokesperson saying:
“We deny these allegations and will respond through the court process. The health and safety of residents are our top priorities. Our team works hard to respond to and resolve maintenance issues and hazards every day.”
The town of Perinton is not listed or involved in the lawsuit. I did give them a heads up that it was filed and asked for a comment. I was told it does not have anything to say at this time.
